Legal aspects: â⬠¢ Liability: First of all, regarding risk management, the organising team of the event can be held liable for its actions or omissions. According to Silvers, liability means ââ¬Å¾the legal responsibility for oneââ¬â¢s actions or omissionsâ⬠(Silvers, p.56, 2013). An important question regarding legal aspects is ââ¬Å¾who owns the eventâ⬠? The legal owner of an event can range from the organising committee, sponsors and the coordinator. Therefore, ââ¬Å¾whoever assumes ownership for the event entails legal responsability and therefore liabilityâ⬠(Bowdin, p.330, 2006) In order to avoid being taken liable for the participants actions, such as an injury, every reasonable precaution must be considered and taken care of. This should be done through a risk assessment, therefore considering and trying to avoid any possible negative risk that can occur. This legal responsibility for actions and omissions is called duty of care, and is covered by an area of law kno wn as torts(Bowdin, p.339, 2006). The duty of care states in the Health and Safety Executive from 2003 that ââ¬Å¾An employer does not have to take measures to avoid or reduce the risk if they are technically impossible or if the time, trouble or cost of the measures would be grossly disproportionate to the riskâ⬠.
